Santa Ana drunk driving accident, 10 year old hit in crosswalk

drunk driving accident has left one Santa Ana family devastated after their son was critically injured by a drunk driver. The ten year old boy was in the crosswalk at 17th Street and Cabrillo Park Drive when Suray Leon, the drunk driver of a Ford F-150, ran a red light and struck the child. The boy was taken to the hospital in critical condition. Suray Leon now faces charges for Felony DUI.

Injuries sustained by a child from a drunk driving accident are cataclysmic. Orthopedic injuries such as broken bones and disfigurement as well as neurologic injuries such as disc herniation, concussion and Complex Regional Pain Syndrome are likely. Brain injuries with long lasting cognitive deficits also occur in automobile vs pedestrian accidents.

These accidents leave deep emotional scars. This is an extraordinarily traumatic event, which can cause post-traumatic stress disorder (PTSD). This too robs a child of their childhood and those developmental years.

Clearly the drunk driver is liable for the injuries and damages discussed above. Those damages include economic damages such as medical and hospital bills. Also included are non-economic damages such as emotional injury, pain and suffering and humiliation. In Drunk Driving injury cases, the drunk driver pays to the victim punitive damages which are to punish and make an example of the drunk driver.

Many people elect to carry minimal liability automobile insurance. In California the statutory minimum liability policy limit is $15,000 per person. This small policy limit is woefully inadequate for the damages sustained by the victim.

However, even in this pedestrian case, if the parents of the 10-year old child have an automobile insurance policy with uninsured motorist coverage, that coverage will be available for the child. Uninsured motorist coverage is available even if the victim is a child. Every person should carry uninsured motorist coverage with policy limits as great as possible, and certainly not less than $500,000 per person. This is your insurance in the event you or a family member is the victim of an inadequately insured driver.
