San Diego personal injury, Uber driver attacks female passenger

Uber is in more hot water, following a personal injury law suit brought against the company in March, 2014. This latest suit, brought by a female Uber passenger, alleges that a male Uber driver repeatedly fondled her while she was a passenger in the vehicle. After the female passenger moved to the front seat to help direct the driver, he began making lewd comments and repeatedly fondled the woman's legs, breasts and groin area. The passenger demanded that the driver stop and let her out, but the driver locked the doors and refused to let her leave. The passenger was eventually able to escape after she threatened to call the police.

The suit, filed in Cook County Illinois against the driver, accuses him of negligence, willful and wanton misconduct, battery, intentional infliction of emotional distress and false imprisonment.

Additionally, Uber itself will face a common carrier suit for failing to have adequate measures in place to prevent this type of attack.  Further, the hiring, training and supervision protocol of Uber and other rideshare companies will likewise be the basis for the direct responsibilty and liability of the company.

San Diego residents should be concerned about their well-being whenever they choose to use Uber, Lyft or Sidecar. Uber, Lyft and Sidecar originally declared their businesses as "tech" companies and circumvented numerous local, state and federal regulations and oversight with which taxis and other common carriers have to comply. This has led to a quagmire of complicated litigation, as more and more individuals are harmed by Uber, Lyft and Sidecar drivers.

When these situations arise, it is critical to obtain experienced legal counsel to help resolve these difficult legal problems. An experienced personal injury lawyer will conduct a thorough investigation to determine all those liable for the harms caused, and ensure redress for the victim.

I haven't more than a layman's understanding of legal matters, but couldn't that man also be charged with attempted kidnapping? I know the parameters vary from one jurisdiction to another, but I'm genuinely interested (it's an inexorable joy to see evil people put away for as long as possible).

First, thank you for following our Blog. We discuss topics and events happening in our society and how legal counsel can help people who have been injured by the wrongful acts of others. Our law firm represents those victims in civil actions against the culpable individuals and companies. Your comment is aimed at the criminal side of the event. The answer to your question is yes the driver faces criminal charges. However, it is interesting to see how the criminal side and the civil side of events parallel one another. You mention "kidnapping" which is a crime. The same act on the civil side is "false imprisonment" which we discussed in the blog. Thank you and visit us often. We appreciate and welcome your comments and questions.
