UPDATE FedEx Wrongful Death, first suit in I-5 school bus head-on

The mother of a 17-year-old student who was among 10 people killed in a highway crash on Interstate-5 earlier this month has filed suit against FedEx for the wrongful death of their child. The suit, filed on April 22nd in Los Angeles Superior Court, accuses the FedEx driver of negligence and alleges that FedEx failed to properly maintain its vehicles in safe working condition.

The suit highlights the fact that FedEx has a history of vehicle fires, and failed to take proper precautions to prevent the fires despite being aware of the issue. Eyewitnesses in this case claimed that the FedEx truck was on fire before it collided head-on with the chartered school bus. However, an investigation conducted by the NTSB found no physical evidence indicating that the truck was on fire at the time of the collision.

As we discussed in our earlier blog, under the doctrine of respondeat superior, FedEx is still responsible for the negligence of its driver regardless of whether or not the FedEx truck was on fire at the time of the accident.

Given the sheer scope of this tragedy, it is near certain that this will not be the last suit filed against FedEx. Unfortunately for the victims of this accident, time is not on their side for multiple reasons. If it is discovered that deficient lighting and roadway conditions contributed to the accident's occurrence, then the State will share in the liability for the accident. However, victims and their families only have 180 days to file an administrative claim with the State. Additionally, evidence of the accident must be collected and preserved as soon as possible to ensure that it best reflects the circumstances of the accident at the time it occurred.
