Wrongful Death, Uber Expands Coverage for San Diego Victims

Following a precedent-setting wrongful death suit brought against Uber earlier this year, Uber and Lyft have expanded their insurance policies to cover accidents that occur while a driver is accepting fares but is not currently transporting a customer. Prior to the change, Uber's insurance policy would only cover their drivers' accidents if they were carrying a customer at the time the accident occurred. If an accident occurred while the driver did not have a fare, the only source of recovery for the victims was the driver's personal insurance coverage.

Uber's new policy kicks in up to $100,000 in coverage for injuries if a driver's personal insurance declines the claim. Uber's "insurance gap" coverage seems to be Uber's way of ensuring some level of coverage.

The additional coverage provided by Uber is inadequate when compared to the damages caused by automobile accidents and especially wrongful death claims. The inadequacy of coverage underscores the importance of carrying uninsured motorist coverage on one's own automobile liability policy.

However, in California uninsured motorist coverage becomes underinsured coverage only if the uninsured motorist policy limit is larger than the liability policy limit of the negligent driver and, in Uber's situation, the "gap" insurance combined. Uninsured/underinsured policy limits do not stack on top of the other side's liability policy. The underinsured limits are reduced by the amount of the other side's liability coverage.

This is one of many reasons to carry uninsured motorist coverage with policy limits as great as possible. Many auto insurance companies offer limits of $500,000 per person and greater.
