Wrongful Death of Escondido Man, Hit-and-Run Driver

A hit and run driver caused the wrongful death of a well-known and well-loved Escondido man on February 3rd. Benjamin Ramirez was struck as he was walking home from a friend's house, following his shift at the local Albertson's. The vehicle involved was a white, box U-haul style, truck. After striking Mr. Ramirez, the driver slowed for a moment before fleeing the scene, leaving Mr. Ramirez to die.

While law enforcement will be charged with locating and ultimately prosecuting the driver for criminal charges, the victim's family should obtain their own personal legal representation in order to seek civil damages for Mr. Ramirez's death. The victim's family is entitled to damages for the wrongful death of their loved one.

These damages, for the victim's family, include future loss of income and the loss of the care, comfort and society for the death of Benjamin Ramirez. Additionally, punitive damages against the driver of the automobile may also be available. The purpose of punitive damages is to punish and make an example of the driver who struck Mr. Ramirez.

In hit and run cases, the victims uninsured motorist coverage and medical payment coverage will be available sources of recovery.  If Mr. Rameriz was a member of the UFCW or other Union benefits and coverages may also be available.
