Pedestrian, Oceanside Hit and Run Accident

A driver killed a pedestrian who was a 53 year-old single Oceanside man on February 26, 2014. Charles D. Soltysiak was struck as he was walking his dog on the Cassidy Street overpass above Interstate 5 around 8:30 p.m. The driver of the vehicle that killed Charles D. Soltysiak has been identified as 23-year-old Christian Thibodeau. After striking Mr. Soltysiak, Mr. Thibodeau apparently panicked, then left the scene, and sped home to get his father.

The details surrounding the accident are still under investigation. Mr. Soltysiak's family is obviously suffering grief and anxiety from the loss. Accordingly, if the driver is at fault for the accident the heirs of Mr. Soltysiak may be entitled to damages for his wrongful death. Wrongful death damages are founded upon the heirs, loss of the care, comfort and society for the death of Charles Soltysiak.

Additionally, punitive damages against the driver of the automobile may also be available. However, these damages will only be available if Mr. Thibodeau made a conscious decision to disregard the rights of Mr. Soltysiak, resulting in his death. The reason for punitive damages is to punish and make an example of the offender.

Mr. Soltysiak's own automobile insurance coverage may be available for the heirs even though Mr. Soltysiak was a pedestrian. Uninsured motorist coverage and/or medical payment coverage can provide a source of financial relief for his family or his next of kin.

Additionally, the roadway, area lighting and circumstances of this, and every accident, should be promptly investigated, documented and preserved. Other people and entities may share the responsibility for this tragic accident.

Experienced legal counsel can help Mr. Soltysiak's family take control of this chaotic and tragic situation by initiating timely investigation, preserving evidence, coordinating insurance benefits and securing recovery.

Hit and Run seems to happen frequently in San Diego. I was surprised to learn that a person's automobile policy covers a person as a pedestrian. Interesting, Thanks for the info.

Sally, thank you for your comment. Automobile Uninsured Motorist Insurance is one of the most misunderstood policy provisions. Our web site has a discussion of uninsured and underinsured insurance coverage. If you have questions feel free to contact us at 619-233-6078.
