Slough of Police Dog Bites, Hayward Paying Out Huge Settlements

The city of Hayward is paying $225,000 to settle a case after a kennel worker sustained severe dog bites from a police K-9 that was being boarded at a local kennel.  The kennel worker suffered dog bites to both legs, and had to be treated at a local hospital for an infection that resulted from the dog bites. The case is the third in a string of vicious dog attacks involving Hayward police K-9's, where the city has paid out substantial settlements to the victims over the past year.

In a second case, police officers chasing a robbery suspect threw their police dog over a fence to continue pursuing the suspect. Unfortunately, instead of taking down the suspect, the dog attacked the 89 year-old homeowner, severely biting his leg. The homeowner's leg was amputated because of the dog bites, and the homeowner eventually died from his injuries. Hayward agreed to pay $1.5 million to the homeowner's family for the wrongful death caused by the police dog.

In a third case, a routine traffic stop quickly escalated into a violent frenzy, when police officers who felt threatened by the man they pulled over deployed their police dog on the man. The man was later taken to the hospital to be treated for his injuries. In order to avoid the time and costs associated with litigation, the city agreed to pay the man a $25,000 settlement.

California cities are liable to victims of police dog attacks when the use of the dog is wrongful. A dog is a weapon at the officer's disposal.  When the use of that weapon is negligent, the city is liable.
